Terms of Use
Last updated: August 18, 2026These Terms of Use ("Terms") form a binding agreement between you and Stephane Boutet ("we", "us", "our") governing your use of the Sommaire mobile application ("the App"). They also serve as the End User License Agreement (EULA) for the App.
By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
This agreement is between you and Stephane Boutet only, not with Apple. Apple is not responsible for the App or its content.
1. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service and Apple's Usage Rules. This licence is for your personal or internal business use.
You may not:
- Copy, modify, translate or create derivative works of the App;
- Reverse engineer, decompile or disassemble the App, except to the extent this restriction is prohibited by applicable law;
- Rent, lease, lend, sell, sublicense or redistribute the App;
- Remove or obscure any proprietary notices;
- Use the App in any unlawful way or in violation of these Terms.
We reserve all rights not expressly granted to you.
2. Your Content and Your Responsibilities
You retain full ownership of everything you create in the App: your recordings, photos, notes, transcripts and summaries ("Your Content"). Your Content is stored on your device. We claim no rights over it, and we do not access, collect or receive it.
You are solely responsible for Your Content and for how you use the App. In particular:
Recording others
Recording laws vary by jurisdiction, and many places require the consent of everyone being recorded. Some jurisdictions require the consent of all parties; others only one. You are solely responsible for knowing and complying with the laws that apply to you, and for obtaining any consent required before recording any conversation, meeting, lecture, call or other exchange involving other people.
We are not responsible for how you use the App's recording features, and you use them at your own risk.
Confidentiality and permitted content
You agree not to use the App to record or store content that you have no right to record or store, including material that infringes intellectual property rights, violates confidentiality obligations, or is unlawful.
Backups
Your Content is stored only on your device. We keep no copy and cannot recover anything for you. You are responsible for maintaining your own backups, whether through the App's export features or your device's backup facilities. We are not liable for any loss of Your Content, including loss caused by device failure, loss or theft of your device, deletion of the App, or software error.
3. Artificial Intelligence Features
The App uses Apple Intelligence and Apple's speech recognition, running on your device, to produce transcripts and summaries.
These features are automated and imperfect. Transcripts may misrecognise words, and summaries may be incomplete, inaccurate, or may omit or misstate important details. Output quality depends on audio quality, accents, background noise, language and subject matter.
You must not rely on transcripts or summaries as an accurate or complete record without reviewing them yourself against the source recording. Do not rely on them for any medical, legal, financial, safety-critical or similarly consequential purpose.
Availability of these features depends on your device supporting Apple Intelligence and on Apple's own requirements and content filters, which are outside our control. Apple's safety filters may decline to summarise some content.
4. Subscriptions and Payment
The App offers a free trial period and an optional auto-renewable subscription ("Sommaire Pro") that unlocks additional features.
- Payment is charged to your Apple Account at confirmation of purchase.
- Auto-renewal: your subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
- Managing your subscription: you can manage or cancel your subscription in your Apple Account settings after purchase.
- Price and terms for each option are shown in the App before you purchase.
- Refunds are handled by Apple in accordance with the App Store Terms of Service. We cannot issue refunds directly.
Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
We may change subscription pricing or features. Where a change affects an existing subscription, we will give notice as required by the App Store rules and applicable law.
5. Maintenance and Support
Stephane Boutet is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.

6. Warranty Disclaimer
The App is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that transcripts or summaries will be accurate.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if applicable. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
7. Limitation of Liability
To the fullest extent permitted by law, Stephane Boutet will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, content, profits, revenue or goodwill, arising out of or relating to your use of the App, including any reliance on a transcript or summary, or any loss of Your Content.
Our total aggregate liability arising out of or relating to the App will not exceed the greater of (a) the amount you paid us for the App in the twelve months preceding the claim, or (b) USD $50.
Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above may not apply to you.
8. Product Claims
Stephane Boutet, not Apple, is responsible for addressing any claims relating to the App or your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
9. Intellectual Property
The App, including its software, design, text, graphics and branding, is owned by Stephane Boutet and is protected by copyright and other intellectual property laws. In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, Stephane Boutet, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
10. Legal Compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Third-Party Terms
You must comply with any applicable third-party terms of agreement when using the App, including the App Store Terms of Service and your wireless carrier's terms.
12. Apple as Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Termination
These Terms remain in effect until terminated. Your rights under this licence terminate automatically if you fail to comply with any of its terms. You may terminate at any time by deleting the App from your devices. Sections 2, 6, 7, 8, 9 and 14 survive termination.
14. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions, except where the mandatory consumer protection laws of your country of residence provide otherwise. This does not deprive you of the protection afforded by mandatory provisions of the law of your habitual residence.
15. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date above and post the revised Terms where the App links to them. Your continued use of the App after the revised Terms take effect constitutes your acceptance of them.
16. Privacy
Our handling of information is described in our Privacy Policy, which forms part of these Terms.
